Privacy Policy

FEMMED Formulas (“FEMMED”) is committed to protecting the privacy of our customers ("You"). This Privacy Policy ("Policy") describes FEMMED’s personal information privacy policies and practices with respect to the collection, use and disclosure of personal information.

Subject to this policy, FEMMED does not collect personal information about You (information that could be used to identify You) except when You voluntarily provide it. Personal information is collected by FEMMED when You are asked specific questions and/or when You communicate directly with FEMMED (by way of, for example, questions You may send to FEMMED through e-mail or on feedback forms).  From time to time FEMMED may also collect information about You from third parties but only in cases where You have agreed that those third parties may provide Your information to FEMMED.

FEMMED limits the collection and use of Your information to that which is necessary to fulfill identified purposes or to deliver requested information, products or services to You.  If we intend to use Your information in any way we didn't tell You about previously, we will obtain Your consent for the new purpose or use prior to doing so.  FEMMED does not knowingly collect personal information from children under the age of 18.

FEMMED may disclose Your personal information to those of its affiliates and related companies that agree to treat it in accordance with this Privacy Policy.

FEMMED will not, without Your permission, disclose Your personal information to unaffiliated third parties except that FEMMED reserves the right to disclose Your personal information to: (i) third party service providers for purposes related to supporting our business (e.g., fulfillment services, technical support, delivery services) and providing You with information that may be of interest to You (if You have opted in to receiving such information) in which case we will require such third parties to agree to treat it in accordance with this Policy; and (ii) to third parties in connection with a sale, assignment, merger, amalgamation, plan of arrangement or other transfer of the FEMMED business (including but not limited to all pre-sale, assignment, merger, amalgamation, plan of arrangement or transfer activities and all transaction negotiations and due diligence activities) to which the information relates, in which case we will require any such buyer, assignee, successor party, transferee or other party related to the transaction to agree to treat the information in accordance with this Policy.

We may from time to time use outside third party suppliers to do work for us involving some of Your information - for example, to perform computer services on our behalf, to analyze survey results or marketing data or to administer to manage promotions or contests or for other reasonable purposes.  We select the company carefully and confirm that it uses privacy and security standards that meet FEMMED's requirements. If such third parties are located outside of Canada, FEMMED will notify You prior to any such transfer taking place.

Except with Your consent or as described in this Policy, FEMMED will otherwise only disclose Your personal information to third parties in the following limited circumstances: (i) if a law, regulation, search warrant, subpoena, court order or order of an administrative tribunal or other body authorized to compel the disclosure of such information legally requires FEMMED to do so; (ii) if the rights or property of FEMMED, its affiliates, subsidiaries, third party service providers or the others are in jeopardy; and (iii) if the personal safety of users of the FEMMED website or other members of the public are in jeopardy. In certain circumstances, FEMMED may have to collect, use or disclose information without consent for its protection. For example, we may do so to detect, investigate or prevent fraud.

FEMMED may, however, disclose aggregated information that does not allow You to be personally identified to third parties.  FEMMED does not sell, trade, or rent Your personal information to others for marketing purposes.

When You visit the FEMMED websites, those sites may use various technologies to collect information from You while You are visiting. Such technologies allow the FEMMED sites to collect a range of non-personally identifiable information, including Your Internet Protocol (IP) address (a unique identifier automatically assigned to Your computer when logging onto the Internet), the type of Web browser and operating system You use, the date and time You visit the FEMMED sites, the specific pages You visit on a FEMMED sites and the address of the site(s) You visited before coming to a FEMMED site.

FEMMED typically uses such information for a variety of purposes, such as to administer the FEMMED sites, customize the FEMMED sites to Your preferences, and compile aggregated statistics for marketing and research purposes. FEMMED reserves the unrestricted right to use this non-personal information, including, but not limited to, selling, leasing, permitting access to, or otherwise transferring it to our affiliates, business partners, advertisers and other third parties.

FEMMED may also collect information about You and Your use of the FEMMED sites through the use of “cookies”. Cookies are small text files that store information about Your interactions with a particular website, either temporarily (known as a "temporary" or "session" cookie, and deleted once You close Your browser window) or more permanently on the hard drive of Your computer (known as a "permanent" or "persistent cookie"). Cookies may make it easier to use a website by allowing servers to access certain information quickly.  "Session" cookies can be used to help a user's browser navigate a website more smoothly and may show up if the user comes from a website with which the subsequent website has some relationship (e.g., a website of an affiliated company) and can give helpful information.  Some web browsers can be set to reject all cookies.  However, if You choose to modify Your browser in this manner, some pages of the website (or other websites You may wish to access) may not function properly.

Subject to legal and contractual requirements, You may change or withdraw Your consent to FEMMED’s collection, use or disclosure of Your personal information at any time by contacting us as noted below or by such other means as may be available from time to time – such as, for example, “unsubscribing” for services to which You may have subscribed.

Withdrawing Your consent will generally not affect Your relationship with FEMMED but doing so may limit FEMMED’s ability to provide products or services to You.  We will advise You of the implications, if any, of withdrawing Your consent.

FEMMED may collect aggregated, anonymous information (such as demographic and profile data, usage and selection data and similar information and data) about You, including in connection with Your use of a FEMMED site, Your participation in various FEMMED promotions or contests and otherwise in connection with the purchase of FEMMED products and use and/or share that information with other third parties (such as FEMMED service providers, agents, marketing consultants and advertisers) in order to better understand and learn more about our customers and their preferences, improve our products, services and the FEMMED sites and for related marketing and research purposes. Any such aggregated information will not contain personally identifiable information about You.

FEMMED will keep Your information only for as long as it is reasonably necessary to fulfill the purposes for which it was collected, unless and to the extent a longer retention is permitted or required by law. Your information is destroyed when it is no longer needed or it is converted to an aggregated and anonymous form. The length of time we keep Your personal information varies depending on the reason it was collected and the nature of the information. For legal reasons, we may keep information beyond the end of Your relationship with us.

You have the right to access, verify, rectify and update Your personal information.  FEMMED takes reasonable steps to ensure Your personal information is as accurate, complete and up-to-date as is necessary to meet the purposes for which the information was collected.  If You notify us that Your personal information is inaccurate or incomplete, we will take steps to correct, delete, or add to it, as appropriate.

You may contact FEMMED to request to know what personal information FEMMED may have collected and retained about You and how that information is being used.  Upon request, and subject to the privacy rights of others and applicable laws, we will make that personal information available to You.

FEMMED uses reasonable efforts to protect information that You provide to FEMMED once it has been received by FEMMED. FEMMED employs physical, administrative and technical safeguards, reasonably appropriate to the sensitivity of the information, to safeguard Your personal information against loss, theft, misuse, unauthorized access or disclosure and alteration.  FEMMED uses SSL (Secure Socket Layer) technology, an encryption technology used to encrypt information sent from Your computer to our servers over the Internet. Unfortunately, no data transmission over the Internet or system can be guaranteed to be 100% secure.

Although FEMMED uses reasonable efforts to safeguard Your information, FEMMED cannot ensure or guarantee that any information You provide to FEMMED is completely secure from individuals who might attempt to deliberately evade security measures, including by intercepting transmissions over the Internet. You provide FEMMED Formulas with Your information at Your own risk.

In order to protect the security and confidentiality of any personally identifiable information supplied by You to FEMMED (such as website passwords and similar information relating to or concerning You) You are responsible to ensure all such information is kept confidential and secure by You.
